These terms ("Terms") govern your use of Pourmetrics SpotCheck ("the Service"), a stock spot-check and variance reporting platform for hospitality venues, operated from Ireland. By signing up for or using the Service, you agree to these Terms.
You need an account to use the Service. The first person to sign up for an organisation is the "account owner" and is responsible for inviting staff, managing billing, and ensuring their use of the Service complies with these Terms. You're responsible for keeping your login credentials secure.
Free trials are 14 days, do not require a card, and give you full access to any self-serve tier (Solo, Venue, or Multi). At the end of the trial you must add a payment method to continue using the Service. Paid plans are billed monthly in advance by our payment processor Stripe. Pricing is shown on our marketing site and may change with 30 days' notice to existing customers.
You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period. We don't issue pro-rata refunds for partially-used months. If the Service has a material defect that prevents use and we don't fix it within 7 days of being notified, you can request a refund for the affected period.

You retain ownership of your venue data (products, spot checks, POS imports, variance reports). We store and process it on your behalf to provide the Service, under the privacy policy. You can export your data at any time while your subscription is active. After cancellation we retain it for 90 days in case you reactivate, then delete it from live systems.
We'll make a reasonable effort to keep the Service available and working correctly. We don't guarantee uninterrupted service — we may need to take the Service offline for maintenance, and we'll give advance notice where we can. If the Service is unavailable for more than 8 hours in a given month due to our fault, we'll credit you for the affected time on request.
The Service is provided on an "as is" basis. To the extent permitted by law, our total liability to you under these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We're not liable for indirect or consequential losses (lost profits, lost stock value, lost business opportunities) arising from your use of the Service.
This clause does not limit liability for fraud, personal injury, or anything else that can't be excluded under Irish law.
You can close your account at any time. We can terminate your account for material breach of these Terms (including non-payment) with 14 days' written notice, or immediately in the case of unlawful use or security risk. On termination we'll delete your data per the privacy policy, except where we need to retain it to meet legal obligations.
These Terms are governed by the laws of Ireland. Any dispute will be heard in the Irish courts.
We'll email account owners at least 30 days before any material change to these Terms takes effect. Continued use after the effective date means you accept the revised Terms.
